He should use that vacation day to start looking for another job.
Edit: I would think there is a very fine line between ';encouraging to be laid off'; and ';getting yourself rightfully fired';. He should continue working and looking for a new job if things are looking bad for his company. If I had a choice between being laid off and losing vacation days, unless I had another job for sure lined up, I would take losing vacation days every time.Can my husband's company force him to use a vacation day because they don't have any work?
It's called a furlough. Most companies have a planned furlough like a Christmas time and you either use your vacation time or take the time without pay. It's perfectly legal. It does not sound like things are going well with the company, unless it is seasonal-type work and it's the off-season. I'd start looking for something else.
Unfortunately they can do this. The lucky ones who were sent home can file for unemployment. The ones who are asked to stay or use vacation days can not. If you husband does not go to work voluntarily then he can't file unemployment because one of the weekly questions is ';did you refuse any work'; and the employer will file and win the appeal. Legally companies do not have to offer sick or vacation days so there is no recourse. It sounds like the company may be in trouble. It may be time to start applying for other jobs.
Well if he would use a sick day now, they're going to know that he was going to take off and he's not really sik, so if you DO decide to use a sick day, don't let ANYONE SEE HIM!
