Can my husband be deported to mexico if I am legal?

Ok my husband and I have been married for 6 years with 2 kids. we pay taxes and everything, but my question is can he be deported to mexico? i was born and raised in the US but he came here from mexico when he was 14 with his mom. Then we got married when we were 18. Can he be deported?Can my husband be deported to mexico if I am legal?
When you say you both pay taxes (we), if you mean income taxes, then he must have a SSN# or a work visa / green card / refugee visa OR he is using someone else's identity, which these days is a major federal crime. This is something else to consider separately.





You don't really say if he is illegal or not - Did he come to the USA on a work/school visa and overstayed, or as a visitor and never went back?





Is his mom still in the country, and is she now a legal immigrant? If she became legal he might have some kind of status as a dependent child.





If i assume that he is here illegally, yes he can be deported, even if he had children with you. Being married for six years could help - he may be eligable for some kind of federal immigration program OR he might have to go back to mexico and apply for residency/immigration status.

If he is illegal he sure can. The Patriot Act voided legalizing citizenship through marriage. He must be legal going through the process of applying for citizenship regardless of his work, marriage status etc. My neighbor just got deported for this very same reason leaving behind a wife and kids.





I have heard of instances where some family is also arrested for harboring and aiding fugitives. You have to remember, if they are illegal then they are classified as criminals.

If he is here illegally, then yes he can, no matter that he is married and has children. You can get in trouble for marrying an illegal alien.
Of course, he can be deported at any time. He is an illegal alien, breaking the rules of this grand country daily.
